Who We Are
The Digital Aviary (“we,” “our,” or “us”) helps animal shelters and rescues share authentic community stories to inspire adoptions, donations, and volunteerism. We collect photos, videos, and stories from fosters, adopters, volunteers, and supporters (“Creators”) to highlight the life-saving work of our nonprofit partners.
What Happens When You Give Permission
By replying “yes,” using a designated hashtag we provide, or otherwise giving clear approval (including emoji approvals such as 👍 or ❤️), you grant us and the nonprofit organization we represent a non-exclusive, royalty-free, worldwide license to use the specific content identified (“Content”) in nonprofit communications.
Uses may include:
Social media posts and stories
Websites, blogs, and email newsletters
Printed materials, reports, and educational resources
Fundraising appeals and campaigns (including paid promotion of those campaigns)
Presentations and other nonprofit marketing
Case studies, portfolio examples, or promotional materials for The Digital Aviary
We may adapt or edit Content for length, size, or format, but we will not alter the meaning of your story.
Your Confirmations
By granting permission, you confirm that:
You created or own the rights to the Content, or you have permission to share it.
Anyone identifiable in the Content has consented to its use.
If the Content includes a child under 18, you are the parent/guardian (or have their consent) and grant us permission to use it.
The Content does not contain unlicensed music, logos, or other third-party materials that would require additional permission.
Credit
When feasible, The Digital Aviary and/or its Clients will credit you by name (e.g., “Photo by Jane Doe”). Credit may not always be possible due to formatting, space, or platform restrictions, and is not guaranteed.
Limitations
You retain ownership of your Content.
The Digital Aviary and its Clients will not sell your Content to third parties.
Content may be edited for clarity, length, or formatting, but will not be altered in a misleading way.
No Compensation
There is no payment for granting permission unless otherwise agreed in writing. If we provide any benefit (such as free items, discounts, or other value), we will follow the FTC Endorsement Guides (2023 update) and ensure clear disclosure.
Revoking Permission
You may revoke permission for future use at any time by contacting [content@thedigitalaviary.com]. We will remove the Content from our active libraries and campaigns going forward.
Revocation does not apply retroactively: materials already published or printed may remain in circulation.
Privacy
To document permission, we may store your name, the Content and/or content URL, your approval reply (or consent hashtag) with date/time, and a copy of the Content itself. This information is used only to track permissions, give credit, and manage nonprofit communications.
Copyright Concerns (DMCA)
If you believe your work has been used without authorization, please contact [dmca@thedigitalaviary.com]. We comply with the Digital Millennium Copyright Act (DMCA) and will promptly review and address takedown requests.
Disclaimers & Liability
Submission does not guarantee use.
The Digital Aviary and its Clients are not responsible for unauthorized third-party use of Content once published on public channels.
To the fullest extent permitted by law, you release The Digital Aviary and its nonprofit Clients from any liability related to the authorized use of your Content under these Terms.
Governing Law
These Terms are governed by the laws of the State of Utah, USA, without regard to its conflict of laws provisions.
By submitting Content or replying with approval, you acknowledge that you have read, understood, and agreed to these Terms.
